Estate Planning

Probate

Probate administration is the process of settling a deceased person's estate. This includes gathering the deceased's assets, paying their debts and taxes, and distributing their assets to the proper beneficiaries, which can involve determining who contingent beneficiaries may be in the event one or more are deceased.

Trust administration

Trust administration is the process of managing a trust which includes collecting and managing the trust's assets, paying the trust's bills, and distributing the assets to the beneficiaries in accordance with the terms established by the trust. The attorney makes sure that the trustee is adhering to the terms of the trust, so everyone involved is properly protected.

Estate and Trust Administration

This can be a complex and time-consuming process. If you have an experienced and qualified attorney to help you, the procedure can be relatively painless.
Here are some of the tasks that are typically involved in estate and trust administration:
The first step is to gather the deceased’s assets. This includes real estate, personal property, bank accounts, investments, and any other assets that the deceased person owned.
Once all of the assets have been gathered and secured, the next step is to pay the deceased person's debts and taxes. This includes funeral expenses, outstanding bills, (be sure to check with the attorney before you pay any bills,) and estate taxes, if any. It should be noted that very few estates are liable for federal estate taxes. The state of Florida has no death tax. Once all the debts and taxes have been paid, the personal representative or trustee of an estate or trust may have to provide accountings to the beneficiaries. An accounting will show how the assets of the estate or trust have been managed and how they will be distributed. If all parties agree, it may be possible to waive the preparation of a formal accounting
Once all interested parties are in agreement, the final step is to distribute the assets to the beneficiaries. This is done according to the terms of his or her will or trust and done under the direction of the attorney.
